The Health & Safety at Work Act 1974 is the primary piece of legislation covering occupational health and safety in Great Britain. This legislation sets out the duty of care employers have towards employees and members of the public.
The Management of Health and Safety at Work Regulations 1999, (as amended) requires employers to undertake risk assessments and provide adequate training for work activities that have the potential to cause harm to employees. This includes hybrid/agile working arrangements.
During the COVID 19 pandemic, when the Government instructed people to work from home temporarily if possible, the HSE gave out general guidance on homeworking arrangements.
Many organisations now implement hybrid/agile working arrangements as part of employees working contracts. This requires employers to consider staff homeworking arrangements as part of the workplace. With these arrangements, employers must consider:
- stress and poor mental health
- using equipment like computers and laptops safely
- their working environment
Employees must receive suitable information and training to ensure their health, safety and welfare while undertaking hybrid/agile working.

- Recognising, and implementing control measures when dealing with potential hazards in the home.
- Understanding the importance of good posture.
- Avoiding injuries caused by poor lifting techniques.
- Fire prevention methods.
- Evacuating their home safely during an emergency.
- Understanding how to be an effective remote worker.
- Recognising the responsibilities for their own personal safety.
